OFFICIAL CONTEST RULES AND REGULATIONS
The Ben Sherman Win a Trip To London To Attend The Teenage Cancer Trust Concert Series At The Royal Albert Hall Contest (the “Contest”)
CONTEST DURATION
The Contest starts on February 4, 2013 at 12:01 AM ET and ends March 4, 2013 at 11:59 PM ET (the “Contest Period”).
PRIZE
GRAND PRIZE
There is one (1) Grand Prize available in this Contest, consisting of one (1) trip for two (2) people to London, England, including round trip economy airfare for two (2) people from the major commercial airport closest to the Grand Prize Winner’s residence (the “Departure Point”), four (4) nights hotel accommodations in England based on one (1) room double occupancy, $1,000 CAD spending money (or equivalent GBP), one (1) Ben Sherman wardrobe (maximum value $500.00 CAD), and two (2) tickets to the March 22 and 23, 2013 Teenage Cancer Trust concerts at the Royal Albert Hall. Approximate retail value of the Grand Prize is $5,000.00 CAD. The actual retail value will vary based on the departure point and airfare fluctuations.
Travel must be taken from March 20, 2013 to March 24, 2013. The Grand Prize must be taken on the dates specified by Contempo Media Inc. and Jaytex of Canada Limited (the Contest “Sponsors”). If a potential Grand Prize winner is unable to travel on the dates specified, then the potential Grand Prize winner will no longer be eligible to receive a prize in this Contest and another potential Grand Prize winner selected in accordance with these Contest rules and regulations.
The Grand Prize winner and his or her designated Travel Partner must complete and sign a Contest Declaration and Release Form. The Grand Prize winner and his or her designated Travel Partner must possess a valid passport and any other mandatory identification or travel documents required to travel to the United Kingdom at the time they are officially notified as a Potential Winner in this Contest, otherwise the Grand Prize will be forfeit. If a potential Grand Prize winner and his or her designated Travel Partner cannot redeem the Grand Prize within the dates specified, fails to provide proof of a valid passports and other required travel documents, such potential winner will be disqualified and an alternate winner will be selected, in accordance with the “Selection Process” section below. The Grand Prize Winner and his or her designated Travel Partner will obtain and provide proof of sufficient personal insurance prior to departure. The Grand Prize Winner and his or her designated Travel Partner will be required to travel together, on same itinerary.
All incremental costs in using the Grand Prize not outlined in the prize description are the sole responsibility of the Prize Winner including but not limited to: transportation (in the case of a Grand Prize Winner whose prize does not include airfare), and beverages, food, gratuities, merchandise and all personal expenses of any kind or nature.
The Grand Prize must be accepted as awarded, and cannot be transferred, assigned, changed, substituted for another prize, or exchanged in whole or in part for cash, except at the Sponsors’ discretion. If any portion of the Grand Prize is not used, for any reason, no financial compensation will be awarded for the balance. The Sponsors reserve the right to substitute a prize of equivalent or greater value in the event that, for reasons beyond its control, the Sponsors are unable to award the Grand Prize as described in these rules.
Odds of winning the Grand Prize in this Contest depends upon the number of eligible entries received.
HOW TO PARTICIPATE
To participate in this Contest, visit www.sharpformen.com between February 4, 2013 at 12:01 AM ET and March 4, 2013 at 11:59 PM ET, fully complete the official Contest entry form, confirm compliance with the Contest rules and click “submit”, and you will be entered into the Contest.
Limit one (1) entry per person and/or email address during the Contest Period.
No responsibility is assumed by the Sponsors their affiliates, subsidiaries, advertising and promotional agencies, their respective directors, officers, employees and assigns, for any disruption to telephone/wireless network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof. The Sponsors assume no responsibility for lost, late, stolen, misdirected, mutilated, delayed mail, incomplete or illegible entries, as well as any printing, administrative or other error of any kind in connection with this Contest. The Sponsors assume no responsibility or liability resulting from user attempts to participate in this Contest or, if required, download any information necessary to participate in this Contest.
ELIGIBILITY
This Contest is open to legal residents Canada, excluding residents of Quebec, who have reached the age of majority in their province of residence at the time of participation in this Contest.
You are not eligible if you are an employee, representative or agent of the Sponsors, or any of Sponsors’ affiliates, subsidiaries, parent or related companies, advertising or promotional agencies or a member of the immediate family or household of any of the above persons.
The Sponsors assume no responsibility for lost, late, stolen, misdirected, mutilated, incomplete or illegible entries, as well as any printing, administrative or other error of any kind in connection with this Contest. The Sponsors assume no responsibility or liability resulting from user attempts to participate in this Contest or, if required, download any information necessary to participate in this Contest.
Entries will be accepted during the Contest Period only.
SELECTION PROCESS
A random draw will be held on March 6, 2013 at approximately 10:00 AM ET and one (1) selected entrant will be randomly drawn from all eligible entries received for the Grand Prize available in this Contest. The selected entrants will be contacted by telephone, mail or e-mail. In the event a selected entrant cannot be contacted within two (2) days of the selection date, another entrant will be selected in accordance with these rules.
In order to be declared a Winner of the Grand Prize, a selected entrant must complete and sign a Release & Indemnity Form and correctly answer, unaided, a time-limited mathematical skill-testing question, without assistance or electronic aid, to be administered at a mutually convenient time over the telephone or by mail. There will be only one (1) opportunity to answer the mathematical skill-testing question. An eligible entrant who provides an incorrect answer will no longer be eligible to win the Grand Prize in this Contest. The procedure outlined above will be followed until the Grand Prize in this Contest has been awarded.
The selected entrant and his or her designated Travel Partner will have two (2) days to return their Release & Indemnity Forms to the independent contest administrator. If a selected entrant and his or her designated Travel Partner do not return their Release & Indemnity Form within two (2) days, the entrant will be declared ineligible and another entrant will be selected in accordance with these rules.
ENTRIES
All entries become the property of the Sponsors and none shall be returned. By entering this Contest, entrants indicate their consent to their personal information being stored, used and processed for purposes concerning this Contest by the Sponsors. The declared Prize Winner’s information including their names, mailing addresses, telephone numbers and/or e-mail addresses, will be shared with the Sponsors and the independent contest administrator, as required to award the Grand Prizes in this Contest.
RIGHTS RESERVED
The Grand Prize available in this Contest must be accepted as awarded and are not transferable and no substitutions will be made, whether in cash or otherwise, except at the Sponsors’ sole discretion. The Sponsors reserve the right to substitute a Prize of equivalent or greater value in the event that, for reasons beyond its control, the Sponsors are unable to award the Grand Prize as described in these rules.
In the event that the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, including any network server or hardware failure, errors in programming, printing, distribution or production errors or any other errors or other causes of any nature whatsoever beyond the reasonable control of the Sponsor and/or their agencies which corrupt or affect the administration, security, integrity or proper conduct of this Contest, the Sponsor reserves the right to terminate or suspend the Contest, in whole or in part, or modify it in any way, at the Sponsors’ sole discretion, without advance notice.
The Sponsors reserve the right to disqualify any individual that it finds to be in violation of these Official Contest Rules and Regulations or tampering with the Contest process. The Sponsors reserve the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and the Sponsors reserve the right to seek damages or other legal remedy to the fullest extent permitted by law.
GENERAL
By participating in this Contest, entrants agree to comply with the Official Contest Rules and Regulations and with the decisions of the Sponsors, which are irrevocable and shall be legally binding in all instances.
By participating in this Contest, the Prize Winner agrees to sign a Declaration and Release Form in the manner prescribed herein, releasing the Sponsors, their affiliates, respective advertising and promotional agencies, and the independent contest administrator from any liability in connection with this Contest or the Prize awarded. The Prize winner also agrees to have and his or her designated Travel Partner sign a Declaration and Release Form in the manner prescribed herein, releasing the Sponsors, their affiliates, respective advertising and promotional agencies, and the independent contest administrator from any liability in connection with this Contest or the Prize awarded.
By participating in this Contest, all entrants agree to the use of their name, address (city and province only), photo, and/or image on videotape for publicity purposes relating exclusively to this Contest without compensation.
By accepting a Prize in this Contest, the Prize Winner and his or her designated Travel Partner absolve the Sponsors, their affiliates, subsidiaries, advertising and promotional agencies, prize partners and/ or suppliers, the independent contest administrator, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of a Prize. The Prize Winner and his or her designated Travel Partner assume all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a Prize.
This Contest and the terms and conditions contained in these Official Contest Rules and Regulations, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in Toronto, Ontario, Canada.
This Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited.
